President's update: Comments on AUN's meetings with political parties (Jan 31, 2005)

To our members and website readers: There has been some interest and perhaps concern expressed about the widely reported meeting Enrique Climent, our Vice President and I had in Valencia in mid January with senior members of the PSPV/PSOE, that is the Valencian Socialist party (see the article below). The two officials were Eugenio Burriel, and Francesc Signes, who are the ones responsible for "Urbanismo" and environmental issues for the Socialist party in the Valencian Cortes (legislature). Burriel was the Minister (Conseller) for the Socialists in 1994 when the infamous LRAU was adopted, over the sharp criticism of the then opposition PP, which won the elections the next year.

We wish to assure everyone that we have gone neither mad nor political. As we explained to the PSPV and the media, we intend to speak to all the parties-on a non partisan basis, to build support for or at least understanding of our positions, before the wretched new land law- the very unlovely "LUV" ( Ley Urbanistica Valenciana) comes before the Cortes. We'll even ask to see the PP-but we are sure they wouldn't see us until we turn up the heat by seeing the others. To some extent we started this round some months ago with calls on Sr. Blasco and the Sub Delegada for Alicante- appointed by the PSOE in Madrid. With the Socialists we were also now trying to get them away from defending the, LRAU etc. since they created that one back in 1994-over the opposition of the PP. I believe we did that- now they blame the PP for what became that party's law, since the original "high purpose" was subverted in a decade of PP rule. Burriel, who is one of the intellectual heavyweights in the PSPV, apart from being the "responsible" Socialist minister when the LRAU was passed into law, has become a solid foe of his former political ally, Blasco, whom he replaced in 1992/3 when Blasco got kicked out of the cabinet for a scandal involving the Salinas in Calpe.

To the extent we could, we wanted to get the PSPV away from the line they seemed to be taking a few weeks ago when one of their members wrote a piece in El Pais attacking us and foreigners in general-quickly picked up by one of the PP's flacks in another article in the media it aligns with, if not controls. Given what we were told, I think we can count on the PSPV to be firm in its opposition to the draft LUV when it is debated in the Cortes. What tangible effect that will bring, we'll need to wait and see. It can't hurt our cause-and we should not be seen as lining up with the Socialists-I hope that along with the Greens , etc. it will be the other way around. From our perspective it is better for the various parties in the Cortes to be fighting each other, and looking to support our cause, than attacking us- which has happened. On January 27, in an article in Levante, Manuel Prieto Honorato, writing on behalf of the PP, attacked Burriel in person and laid the blame back on the Socialists- and implicitly the Zaplana PP faction, while praising the efforts of the Camps regime, which will culminate in the presentation of the new legislative "tool" the LUV to the Cortes. AUN was mentioned in the article, but the attack was focused on the PSPV.

The PSPV/PSOE has, as a result of our meeting, publicly pledged to fight "Abusos" under the land laws, just as we have been doing. We part company on some major positions, however. For example, given what we (and FIPE) have ascertained from real estate agents, Spanish and foreign , the housing market here-as predicted by the Economist , European Banks ( EIB, etc. ) and others, is very soft, we cannot agree with the PSPV that there is an "enormous" amount of development pressure on the Valencian Community, notwithstanding the climate. The pressure is a "land grab" one, pure and simple. The LRAU inspired system distorts normal market forces and results in the costs of purchase being so artificially high that there are relatively few buyers in relation to the land available. That of course hurts the constructors more than the promoters, who grab land, borrow money against that land at their elevated prices, and then often ship their takings offshore. The high cost of land then provides the "social" justification for continuing the process, as though normal supply and demand forces were operating freely.

Another core issue dividing us is that of "social interest" (or variously, "public benefit" or "general interest") a vaguely defined concept and a distant ( somewhat illegitimate) cousin of the British " compulsory purchase" or the USA's "eminent domain". The Socialists share the concept with the PP that somehow, given that ownership of property is not considered to be an "inalienable right", in this country, any property is up for grabs by any administration, without any or with only minimal compensation and against no objective or any reasonable criteria. As one of the architects of the land laws, Gerardo Roger, pointed out some time ago, the use of vague expressions such as "social interest" and "public benefit" have been justifying land grabs in Spain -maybe all the way back to Roman times. He was outraged at the attack, eg. by the Petitions Committee on a historic custom. Perhaps he also wishes to bring back "Autos de fé" , and burn a few heretics.

Somehow, just because of the nice climate, there is a belief that there will be an endless supply of buyers, foreigners especially (since Spaniards can't afford the "social responsibility" involved -or are too cunning to get hooked), who are prepared to come here with their hard earned life savings, and buy less and less for more and more, just to surrender their property, bought at retail, at short notice for nothing or next to nothing to contribute to the fortunes of bent politicians or rich developers under the guise of this "social interest" . It is a variation on the classic folkloric childrens' tale about "The Ant and the Grasshopper"- very Grimm indeed. No respect for property rights, nor the Spanish Constitution (eg. Art 33), let alone EU laws and norms or the draft EU constitutional treaty which contains a brief compendium of those rights (Art. II.77) and to which pious and thus far empty pledges are made by both the PP and the Socialists.

Our PSPV interlocutors realized that the PP government is trying to grasp the moral high ground from the Socialists by laying emphasis on the need for "social housing". Fine in principle, but the practice will likely be something else and it may just be more smoke than fire. To some extent, if not at best, this is a "make work" scheme for the constructors who can't build and sell elsewhere. The question is where the money will come from to build the tens of thousands of "VPOs" for Spaniards who can't afford entry into the normal housing market. That said, "social housing" has its own dynamic. It is known for example, that such building can be converted into tourist housing, second or retirement homes, very easily. In some instances, buyers will pay large amounts of "black money" under the table to get officially subsidized housing from the builders. All this would not be so serious, but for the fact that construction has become the "mono culture" that, in the main, drives the Valencian economy, at a time when tourism is suffering, and agriculture and industry are flagging badly. It is unlikely that the PSPV and the PP will disagree on this high sounding issue. The Socialists did however, like the Petitions Committee fact finding mission, call for a halt to the approvals of NEW development plans- not construction, as Blasco has misconstrued matters in his statements.

All the above taken into account our meeting with the PSPV can be a boost for us elsewhere – the Socialist MEPs should know (since we've copied them on the articles) they no longer have to be defensive parents as regards the LRAU in Brussels and we might also gain some support in Madrid ( via Borrell who is now in our info loop, and thus to Narbona and other national ministers. Our success in getting through to such policy level people, including Rafael Blasco , was the subject of an article in the press on Jan. 23rd.) Borrell himself could be a big help as Europarl President when the next investigation team comes here in April- so we believe- and more so when it presents its report to him and the parliament. The courts here will also note the criticism of the "abusos" committed and encouraged under the land laws- I believe that will play in the favor of the victims, and that's what Burriel suggested too.

Necessity often makes for strange bed fellows. We went into the meeting with some solid objectives, well aware that some of the towns PSPV/PSOE members control are just as bad as those under PP domination. I think we got it right this time. We are now seeking a meeting with the PP led Diputación de Alicante to press our case.

El vicepresidente de la asociación, Enrique Climent, afirmó que han iniciado una ronda de reuniones con los diferentes grupos políticos con representación en las Cortes, para informarles de su postura y entregarles un informe con comentarios y propuestas alternativas al borrador de la LUV.La primera reunión se celebró esta tarde cuando Climent y el presidente de la agrupación, Charles Svoboda, fueron recibidos por el secretario de Territorio y Vivienda y el secretario de Medio Ambiente del PSPV-PSOE, Eugenio Burriel y Francesc Signes, respectivamente.Según manifestó Climent, los socialistas comentaron que tenían "muchos puntos de conexión", por lo que este encuentro podría ser la primera de una serie de reuniones para comentar el problema urbanístico en al Comunidad Valenciana.Tanto Burriel como Signes se comprometieron, según el vicepresidente de "Abusos Urbancisticos No", a estudiar el informe y a convocarles en un futuro para "concretar y desarrollar los puntos coincidentes".Climent afirmó también que el secretario socialista de Territorio y Vivienda les entregó un dossier con recomendaciones dirigidas a los alcaldes de su partido para aplicar la ley en temas urbanísticos, "gracias al cual hemos comprobado que coinciden con nosotros en muchos puntos".Respecto al Gobierno valenciano, Enrique Climent aseguró que el pasado 13 de octubre remitieron el mismo informe al conseller de Territorio y Vivienda, Rafael Blasco, "que se comprometió a estudiarlo y a darnos una respuesta al respecto"."Hasta la fecha no hemos recibido respuesta alguna por lo que hemos decidido informar al resto de formaciones políticas para que conozcan nuestra postura", añadió el vicepresidente de la asociación.En cuanto al borrador del anteproyecto de ley, desde la asociación aseguraron que es un documento "que no pasa de ser una estafa legal" y que incurre en "una falta de respecto a la ciudadanía".Señalan que fomenta las urbanizaciones "innecesarias para un desarrollo social y sostenible en forma de campos de golf que destruyen el patrimonio agrícola valenciano".Climent señaló que, a falta de matizar las actuaciones concretas, también prevén trasladar su campaña de información a la sociedad e incluso pretenden realizar una manifestación en Valencia en el mes de marzo

El secretario de Territorio y Vivienda del PSPV-PSOE, Eugenio Burriel, y el de Medio Ambiente, Agua y Agricultura, Francesc Signes, han mantenido esta tarde una reunión de trabajo con la Asociación ‘Abusos Urbanísticos No’ para analizar la actual legislación urbanística y para darles a conocer los pormenores de la política por la que apuesta el PSPV-PSOE en esta materia. Según Burriel, “los socialistas valencianos estamos totalmente en contra de los abusos urbanísticos. Por ello, la Comisión Ejecutiva aprobó, a finales de 2004, unos criterios de actuación urbanística para los Ayuntamientos socialistas que buscan, entre otras cosas, hacer frente a la mayor parte de los problemas que preocupan a la mayoría de la ciudadanía de la Comunidad”.

Entre dichos criterios, el responsable socialista destaca “la garantía de transparencia y objetividad en los procesos de gestión y aprobación de los programas de urbanización; asegurar la información, participación y defensa de derechos de los propietarios afectados; incidir en la dirección pública del proceso urbanístico, desde los Ayuntamientos, y colocar al agente urbanizador en su auténtica posición legal de subordinación a los intereses generales y a las políticas municipales y fijar modelos territoriales respetuosos con la calidad del territorio y que apuesten por un crecimiento prudente y beneficioso para el futuro. Criterios que recogen casi todas las recomendaciones del Informe al respecto del Síndic de Greuges”.

Igualmente, Burriel explica que “la anunciada nueva Ley Urbanística Valenciana (LUV) del PP no va a resolver los problemas urbanísticos de la Comunidad sino que incluso puede agravarlos. Además, puede convertirse en la tapadera para cometer más abusos urbanísticos. Sobre todo porque los principales abusos urbanísticos no son consecuencia de la legislación sino el resultado de la política urbanística practicada por el PP en la Comunidad Valenciana en los últimos 8 años. De hecho, la Región de Murcia padece los mismos problemas aunque tiene una legislación muy diferente pero una política similar. Al tiempo, la política del PP ha apostado por un crecimiento urbanístico desaforado y sin ninguna planificación territorial ‘supralocal’, que habría fijado unos límites a los ayuntamientos. Además, -continúa el responsable socialista- no es casualidad que el PP no haya aprobado un Reglamento de Gestión de la Ley Reguladora de las Actuaciones Urbanísticas (LRAU) porque, de esta forma, se permite una mayor discrecionalidad municipal y un menor control del urbanizador. A ello se añade que muchos de los problemas derivan del incumplimiento por algunos ayuntamientos de lo establecido en la LRAU. Incumplimientos que la Generalitat ha tolerado cuando no alentado. Y, ante todo, el borrador conocido de la LUV no resuelve la mayoría de los problemas y agrava otros, como la desaparición de la obligación municipal de hacer el planeamiento de desarrollo”. Con todo, Burriel y Signes se comprometieron a mantener contactos periódicos con la Asociación para analizar los posibles abusos urbanísticos y sus soluciones, así como, en su caso, la posibilidad de estrategias o actuaciones conjuntas.

FYI: A more comprehensive comment on Mr.Blasco's alleged rebuttal of the Petitions Committee Fact Finding mission's report was sent to Spanish language newspapers last evening. According to our current information, despite Mr. Blasco's remarks, no document from the Valencian Government on this matter appears to have been received at the European Parliament. CVS

AUN ANSWERS After viewing the lead story in this newsletter yesterday, the Valencia Life Network has received this reply from the Abusos Urbanisticos-No collective:"While AUN is interested to note that Sr. Blasco has finally realized the importance of the European Parliament, which he dismissed as irrelevant after the Petitions Committee fact finding mission last May-and refused to meet, some facts need to be set straight. The LRAU, of which he was one of the authors when he was a member of the Socialist party, came into effect long after Spain had joined the EuropeanCommunity (now the EU). Hence European laws, treaties and norms should have been and should now be respected. This includes those with regard to the environment, and especially human rights, including those of property owners and contract law, for example. The petitions committee, as Mr. Blasco would know since he has presumably read its report, did not call for a halt to construction. It instead called for a moratorium on the approval of new development plans until the proposed new law to replace the LRAU, and which should also be fully in accord with EU laws and norms, comes into effect. Mr. Blasco will also recall that his government, on July 30, 2004 issued a directive to Mayors and town halls to respect the principles of the newlaw (LUV), which, oddly had not even been completed at that time. Subsequently he stated the LRAU would remain in force until the new law is approved and goes into effect, perhaps not before the end of 2005. Along the way, Mr. Blasco has forgotten his pledge to consult widely on the content of the new law, for example cancelling his announced December meeting with Foreign Consuls at short notice, and ignoring submissions invited from - for example - our association, which comprises both Spanish and foreign property owners. Nor does the most recent draft of the law contain the principal recommendations of the Syndic de Greuges in his special reports on the land laws. AUN will have further comment when it has the full text of the submission to the European Parliament by the Valencian Government."

ANOTHER LAND STUDY It has been revealed that in the ten years between 1990 and 2000, buildings increased in the Valencian Community by 48.98%, resulting in 20,879 hectares of agricultural land and 9,376 hectares of woodland being lost as a result. Whilst the population only marginally increased, the building figure puts the Valencian Community doubles the Spanish national average for the same period of time. These figures were disclosed yesterday by the Corinne Land Cover report for the European Union, and are the result of extensive study of high-resolution photographs taken of the Community from satellites. Nationally, the leader in the building explosion is Murcia - with 52%, Navarre with 50.3% and Madrid with 49.2%, whilst Alicante leads the three provinces of the Community with a 62% increase in building over ten years, followed by Castellon (58.7%) and Valencia with 34%. It was also revealed yesterday that the Conseller for the Territory, Rafael Blasco, has reached an agreement with various town halls in Alicante Province for the creation of protected housing in the municipalities. The towns involved are: Alicante - where 1,156 homes will be created on 321,835 square metres San Vicente del Raspeig where 357 homes will be built on 58,605 square metres El Campello (157 homes on 44,560 sq m) San Juan (618 homes on 201,965 Sq m) - as well as a second programme involving San Juan that will envisage 3,888 new homes on 1,671,386 Sq m; Callosa de Segura (357 homes on 119,000 sq m)Elche (2,020 homes on 980,459 Sq m) Alcoy (122 homes on 13,439 Sq m) Aspe (606 homes on 139,790 Sq m) Petrer (482 homes on 221,203 Sq m) andMutxamiel with 96 home to be built on 74,200 square metres.

ANOTHER SAD CASEAnother terrible case of land abuse has recently come to light concerning a couple who decided to retire to Rocamura, where they bought a 550-tree orange grove and three houses. During three years, the couple lived in a stress-free environment, perfect for their health as livingand working in England had brought on at least two strokes. By accident in November of last year, they overheard plans for a town meeting, which they attended, and to their astonishment heard that their area was up for urbanisation based on the fact that the majority of landowners were in favour of the project. However, a little questioning quickly revealed that no one had been asked any questions whatsoever about any possible building project. Later research also revealed that the local Town Hall had no plans for the urbanisation, had not presented in the official publications of either Alicante or Valencia, and that no environmental studies had been carried out. Notwithstanding all this, the property owners are now being threatened with huge bills to pay for their part of the infrastructure for an urbanisation that no one wants or in fact really knows anything about. Commenting on this, AUN President Charles Svoboda stated that it was a fairly typical case of the land abuses committed in the Valencian Community under the LRAU, but added that he expected things to 'come to a head soon' with regard to action possibly being taken by the European Union over these abuses.

AN OPEN LETTER Yesterday Abusos Urbanisticos NO(AUN) made public its Christmas message- "An Open Letter to the Valencians" in which it clearly set out its worries and concerns over the Valencian land laws known as LRAU or there form of that law which is slated to be put before the ValencianParliament later this year. Signed by Charles Svoboda, the President of the collective, and vice president Enrique Climent, the letter states in its opening paragraph just how disappointed it is with the action or lack of it taken by the Conselleria for the Territory and Housing. The letter goes on: " There has been much public comment that the LRAU does not discriminate against foreign property owners in the Valencian Community, and this is quite correct, and we have never argued this point, for we are convinced that the LRAU treats both foreigners and Spaniards equally badly." The letter adds that the new law does nothingto stop the partnership town hall/urbanizer, when in fact the Town Hall sought to be looking out for the rights of the property owners affected by any urbanizing project. The letter also reminds Rafael Blasco, The Conseller for the Territory, that he did promise the collective that the new law would not be put before the Valencian Parliament without taking into consideration the proposals that the association has manifested on numerous occasions. Commenting on the new law, the letter states that; "We are not jumping out of the frying pan into the fire, we are still inthe frying pan."

CARTA ABIERTA A LOS VALENCIANOS


El borrador de anteproyecto de la Ley Urbanística Valenciana, que todos deseamos cumpla con los principios básicos de las leyes europeas en lo que a Derechos Fundamentales se refiere, y con las regulaciones de los tratados en que España es signataria, tales como la Convención Europea sobre Derechos Humanos o la Carta de Libertades Fundamentales, e igualmente en lo referente a contratos públicos, mantenimiento del Medio Ambiente y Paisaje, y respeto a la propiedad, después de haber sido sometido a un análisis en profundidad, tratando de encontrar las mejoras que a través de la prensa nos han anunciado, nos vemos obligados a manifestar que nos sentimos defraudados.

Desde la Conselleria de Territori i Habitatge, se nos habla de “urbanismo social”, lo que no deja de ser una etiqueta y como tal muy barata de utilizar.
No existe tal urbanismo social si continua siendo el artífice legal del proceso urbanístico el “urbanizador” con la bendición del ayuntamiento de turno, no hemos salido de la sartén para caer en las brasas, continuamos en la sartén.
Todos los atropellos cometidos por aplicación interesada de la LRAU , lo han sido por el tandem “ayuntamiento/urbanizador”, eso bien lo sabe la ciudadanía, y el borrador de la nueva ley refuerza la posición de los ayuntamientos y deja a los urbanizadores con una excelente salud, en verdad creemos que se puede hablar de una “urbanismo depredador”, para este viaje no hacían falta alforjas.

Con respecto a la Ley Reguladora de la Actividad Urbanística de 1.994, poco hemos avanzado , y en algunas cuestiones puntuales se puede hablar de retroceso.
Continua este borrador de ley en la misma línea, no se respetan los derechos de los propietarios y el tan anunciado Estatuto del Propietario solo habla de obligaciones o más bien deberes, no menciona un solo derecho, no obstante cuando habla del urbanizador no habla de derechos, los titula “prerrogativas”, con esta redacción no parece que el tratamiento sea parejo.

Se ha hablado mucho públicamente de que la LRAU no discrimina a los propietarios extranjeros en la Comunidad Valenciana, eso es cierto y nunca hemos manifestado queja en ese sentido, estamos convencidos que esta ley trata igual de mal a propietarios españoles y extranjeros.

Se disculpa el Conseller Sr. Blasco diciendo que hay cuestiones que no se pueden variar en la LRAU, porque las establece la ley estatal, cuando se trata de modificar cuestiones tan puntuales como la cesión a los ayuntamientos del 10% del aprovechamiento urbanístico resultante en cada programa, o bien establecer criterios objetivos de lo que puede considerarse interes social o utilidad pública para proponer un proyecto. Cuando en la exposición de motivos se dice que la ley “..no regula las valoraciones, las expropiaciones ni los supuestos indemnizatorios , por ser estas materias atribuidas en exclusiva al Estado” y desde luego los dos ejemplos propuestos no entran dentro de esa catalogación, por otra parte el art.31.9 del Estatuto de Autonomía de la Comunidad Valenciana en relación con el art. 148.1.3º de la Constitución, atribuye a la Generalitat Valenciana la competencia exclusiva en materia de urbanismo y de ordenación del territorio.
Si no se tienen en consideración estas cuestiones, no creemos que sea una cuestión de leyes estatales, sino más bien de falta de voluntad.

Se nos dice que una de las mejoras introducidas en este borrador, es la extensión del plazo para optar entre el pago en metálico o en terrenos de las cargas de urbanización, de 10 días a 2 meses, lo que se agradece, pero no se dice que al propietario afectado que desee pagar en metálico la misma ley le exige una fianza o aval bancario a favor del urbanizador, y además lo tiene que solicitar mediante escritura pública o comparecencia administrativa, cuando su propiedad continua estando en el ámbito de la actuación y garantiza sobradamente cualquier compromiso, cuando comunicar una opción mediante escritura pública es anticonstitucional, a más de antidemocrático, especialmente si es para pagar en metálico que es el sistema natural en el mundo entero de pagar bienes o servicios, y por ultimo cuando se esta tratando de una cuestión puramente administrativa sobradamente regulada por leyes y decretos .
En la LUV para pagar con dinero se tiene que pedir mediante escritura pública, curiosa forma de defender los intereses de los propietarios.

Como dice el Conseller Sr. Blasco, la nueva ley refiriéndose a los propietarios “les obligará a costear únicamente los costes de urbanización de los servicios públicos que les afecten directamente”, no creemos que esta mejora sea para echar cohetes, ya que se trata de actuar de acuerdo con los principios de equidad y honestidad, que cualquier persona espera de una actuación pública, no obstante agradecemos la concesión ya que pone de manifiesto el carácter depredador y abusivo de la LRAU que se pretende sustituir, pero que curiosamente y a pesar de múltiples requerimientos todavía está en servicio, sin siquiera haberse acordado una moratoria urbanística hasta la aprobación de la nueva ley, y los ayuntamientos como locos aprobando proyectos de urbanización a un ritmo que triplica los aprobados en los últimos cinco años, extrañas prisas, no parece sino que en nuestra Comunidad estamos todavía en la Edad Media urbanisticamente hablando.

Pero el borrador de la nueva ley que dice “… les obligara a costear únicamente los costes de urbanización…” se refiere solo a los propietarios del suelo, que además han tenido que ceder obligatoria y gratuitamente una buena parte de sus terrenos, que puede llegar hasta el 60 ó 70 % de los mismos, sin embargo no habla de que los urbanizadores o ayuntamientos tengan que costear los servicios públicos que les afecten, a pesar de haber recibido terrenos de los propietarios ya sean los que ceden obligatoria y gratuitamente, ya sean aquellos con los que pagan las cargas de urbanización, pues ya se encarga la ley y el borrador de la nueva de especificar que estos terrenos sean entregados libres de cargas urbanísticas, extraño y discriminado favor, que hace que el propietario que paga en terrenos libres de cargas de urbanización, las cargas de urbanización, las paga dos veces, y a pesar de ello su terreno a estos efectos no se valora a precios de mercado de suelo urbano, sino de suelo rustico devaluado.

En la Exposición de motivos de este borrador, se especifica claramente en su párrafo 5º “La necesidad de crear una ciudad más sostenible se convierte axial en uno de los mayores retos del siglo XXI” , más tarde en el párrafo 7º se dice hablando de la LUV “… a través de la cual planifican o definen el modelo urbanístico de ciudad y lo desarrollan con la participación de los propietarios …”.
Hay una continua referencia al desarrollo de la ciudad, pero en ningún lugar se hace mención del desarrollo urbanístico de áreas residenciales apartadas de las ciudades, en suelos rústicos de los llamados “ no urbanizables” y cuyo desarrollo urbanístico no cumple ningún principio de interes social o de utilidad pública, favoreciendo solo a grandes promotores-especuladores que buscan un mercado entre los colectivos que pueden permitirse adquirir este tipo de segundas residencias (en la publicidad se califican “de lujo”) creando una doble disfunción social, de un lado privando de su propiedad a pequeños propietarios y haciéndoles pagar el desarrollo urbanístico (de lujo) y de otro estableciendo núcleos de población estacional de los llamados de alto standing, que por comparación simple ahondan las diferencias sociales.

Preguntamos, porque no se da un tratamiento diferenciado a estas propuestas de urbanización , que solo tienen una finalidad especulativa evidente, y se dejan a la iniciativa privada , sin más intervención pública que la de determinar si la zona es susceptible de desarrollar urbanisticamente , donde el urbanizador si quiere urbanizar tenga que comprar el suelo al precio que el mercado establezca, y corra con los costes de urbanización de los que el solo se va a beneficiar, sino se hace así, estas leyes están favoreciendo a grupos financieros inmobiliarios de forma tan descarada que no se entiende porque, en perjuicio del propietario del suelo , del medio ambiente, de la agricultura tradicional , del paisaje y de todo lo que se supone es propiedad de los ciudadanos.
La Ley Urbanística Valenciana, tal como se auto manifiesta en la Exposición de Motivos, proponemos que se aplique en exclusiva a los programas urbanísticos que ayuden a desarrollar las ciudades de forma sostenible y de acuerdo con el siglo en que vivimos.

No son un ejercicio de imaginación las innumerables manifestaciones de protesta que en los últimos años se están generando por toda la Comunidad Valenciana contra la aplicación desastrosa de la LRAU.
No son un capricho de gentes aburridas las reclamaciones cursadas al Parlamento y a la Comisión Europea contra los atropellos sufridos en la Comunidad Valenciana por la aplicación interesada de la LRAU.
No son infantilismos de pobres gentes ignorantes los recursos , querellas y contenciosos interpuestos ante los Tribunales de Justicia, contra los abusos soportados por la aplicación depredadora de la LRAU.

Todos y cada uno de esos miles de personas están diciendo y pidiendo algo, lo piden alto y claro, pero por desgracia hasta ahora ni con la LRAU ni con la LUV parece que se les haya oído.

Estamos a tiempo , tenemos el derechos a ser oídos y a que se tomen en consideración nuestras peticiones, que son exactamente las mismas que el Sindic de Greuges de la Comunidad Valenciana expuso en su informe, cuyas recomendaciones a pesar de las declaraciones del Conseller Sr. Blasco no han sido tomadas en consideración en la nueva ley, ya que solo se han incorporado 5 de las 13 que en su día propuso, y finalmente las mismas que el Parlamento Europeo a través de informe de su Comité de Peticiones.

No se puede descalificar sin más a todas esas personas y entidades, diciendo que no se quiere aceptar el desarrollo urbanístico de las ciudades, ni atender al pago de los costes que ayuden al mismo, ni alegar que es una cuestión de intereses personales, eso es una mentira manipuladora y como tal un insulto, este clamor es un grito en defensa de unos derechos fundamentales inherentes al ser humano, el derecho a la propiedad, el derecho al medio ambiente, el derecho al paisaje y el derecho a la vida a través de la salud, porque esta se ve afectada , como lo prueba el informe profesional sobre el Síndrome de Castellón, que es conocido sobradamente tanto en la Comunidad Valenciana como en la Europea , referido a la presión psicológica y sus consecuencias en la salud mental de las personas que han sido afectadas por atropellos cometidos al amparo de las leyes urbanísticas valencianas, con una larga secuela de desconexiones, ansiedades y depresiones.

Recordamos desde aquí al Conseller Sr. Blasco su promesa a nuestra asociación hecha el 15 de julio de 2.004 , de que el borrador de la nueva Ley Urbanística Valenciana no sería pasada a Les Corts, sin haber tenido en cuenta nuestras propuestas y peticiones, como representación de un colectivo con derecho propio en el proceso urbanístico, los propietarios afectados por el mismo.

NEW PROJECTS Yesterday the town of Alquerias in Castellon Province became the scenario of yet another urbanising project. This latest effort, presented by the Pont Mediterrani, envisions taking almost two million square metres that are currently taken up with citrus groves and turning it into a large golf course and creating some 3,000 luxury homes. The plan was presented before the Town Council yesterday, and Socialist Mayoress Conseulo Sanz did not make any real statement over the project other than to say it had been presented some time ago. However, what is certain is that if the urbanization is allowed to go ahead, the result would triplicate the population in the town. Meanwhile, Burriana, another town in Castellon, stated that it was intent on building two 24-storey skyscrapers in the beach area of themunicipality. Also currently before Denia Town Council are five plans to build urbanizations in the municipality, adding a possible 1,500 homes, whilst a project in Gata de Gorgos to urbanise some four million square metres by constructing some 6,000 homes and a golf course has been turned down by the Council.

PROFITS DOWN Ricardo Verdesoto, the President of the Benidorm Bars and restaurantsAssociation ABRECA, stated yesterday that for the vast majority of establishments in Benidorm, receipts were down this year by 30%. MrVerdesoto added that ever since 1999, receipts in the Restaurant and bar business in the holiday town had been dropping between five and ten percent annually, but this was the worst drop registered for a single year. According to Mr Verdesoto, the main part of the blame lies with theEnglish tour operators, who were offering better bargains at other locations such as Egypt. He also revealed that after this festive season, all the Benidorm associations linked with tourism will have a special meeting aimed at putting forward a plan for next year.
